These Terms and Conditions govern your use of the EPA Portal operated by EDACCO. Please read them carefully before using our services. By creating an account or accessing the platform, you confirm that you have read, understood, and agreed to these terms.

1. Acceptance of Terms

  • By accessing or using the European Project Agency (EPA) Portal, you agree to be bound by these Terms and Conditions.
  • If you do not agree to these terms, you must not use the platform.
  • These terms apply to all users, including registered members, free-tier users, and subscribers.
  • We reserve the right to update these terms at any time. Continued use of the platform constitutes acceptance of any changes.

2. User Accounts & Eligibility

  • You must be at least 18 years old and represent a legal entity or act in a professional capacity to register.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You must provide accurate, current, and complete information during registration.
  • Each account is personal and may not be shared with or transferred to third parties.
  • We reserve the right to suspend or terminate accounts that violate these terms.

3. Platform Services

  • The EPA Portal provides tools for discovering EU funding programmes, managing grant applications, and accessing AI-powered advisory services.
  • Access to certain features is subject to your subscription plan (Starter, Professional, Enterprise, or Large Enterprise).
  • We strive for high availability but do not guarantee uninterrupted access to the platform.
  • AI-generated content and funding recommendations are provided for informational purposes only and do not constitute professional legal or financial advice.
  • All EU funding programme data is sourced from publicly available information and may not reflect the most recent updates from the European Commission.

4. Subscriptions & Payments

  • Subscription fees are billed in advance on a monthly or annual basis, depending on your chosen plan.
  • All payments are processed securely via Stripe. We do not store your payment card details.
  • Prices are displayed in EUR and are inclusive of applicable VAT where required by law.
  • Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date.
  • Refunds are not provided for partial subscription periods unless required by applicable law.

5. Prohibited Use

  • You may not use the platform for any unlawful purpose or in violation of EU regulations.
  • Scraping, reverse-engineering, or reproducing platform content without prior written consent is strictly prohibited.
  • You may not attempt to gain unauthorised access to any part of the platform or its infrastructure.
  • Uploading malicious code, spam, or content that infringes third-party intellectual property rights is forbidden.
  • Using the AI advisor to generate fraudulent grant applications or misleading project descriptions is a material breach of these terms.

6. Limitation of Liability

  • The EPA Portal and its content are provided 'as is' without warranties of any kind, express or implied.
  • We are not liable for any direct, indirect, incidental, or consequential damages arising from your use of the platform.
  • We do not guarantee that any funding application prepared using the platform will be successful.
  • Our total liability to you shall not exceed the amount paid by you in the 12 months preceding the claim.

7. Intellectual Property

  • All platform content, design, branding, and software are the exclusive property of EDACCO.
  • You retain ownership of any project data, documents, and content you upload to the platform.
  • By uploading content, you grant us a limited licence to process and display it solely for the purpose of delivering our services.
  • You may not reproduce or redistribute any part of the platform without explicit written permission.

8. Governing Law & Disputes

  • These Terms and Conditions are governed by the laws of the European Union and the jurisdiction of Belgium.
  • Any disputes shall first be attempted to be resolved amicably within 30 days of written notice.
  • Unresolved disputes shall be submitted to the competent courts of Brussels, Belgium.
  • If any provision of these terms is found invalid, the remaining provisions shall continue in full force.
